Payments: Entering into this rental contract at
the time of first payment is required. We accept cashier's check,
personal check and cash, made payable to Sonia Connors .
Failure to pay by these procedures will result in a cancellation
of the reservation and forfeit of all monies paid. Any returned
checks will have a $25 charge to cover bank and handling charges.
Security Deposit will be refunded (sent) within 10 business days
after your departure, less any charges incurred according to the
provisions of this contra ct.
RENTAL CONTRACT
GENERAL: Kevin and Sonia Connors,
hereinafter referred to as Owner, and the undersigned, hereinafter
referred to as Tenant agree to the terms as described within this
Rental Contract, including Page 1 (Tenant and Payment Information).
TENANT: The Tenant is an adult and
will be an occupant of the unit during the entire reserved period.
Other occupants will be family members, friends or responsible
adults. Use of the premises will be denied to persons not falling
within the foregoing categories, and as a result they would have
to vacate the property immediately without any refund. No pets
are allowed.
PAYMENT: Payment shall be as described
on page 1 of this contract.
SECURITY DEPOSIT: The security deposit
if $500 for a weekly rental and $1000 for a monthly rental, due
as described in the Payment section of this Contract. Failure to
receive Security Deposit and Payment monies within the time periods
allotted may result in cancellation of your reservation. Your security
deposit is fully refundable within 10 business days of termination
of occupancy provided that real and personal property are in the
same condition as when occupancy commenced and all terms of this
agreement are met. Tenant is Liable for all replacements and repairs
that are outside of what is considered normal wear and tear.
CANCELLATION: Should you wish to cancel
this reservation, notice of cancellation must be in writing and
received more the 30 days prior to your check in date. We will
refund the sums you have paid, less a $75 cancellation fee. If
your notice of cancellation is received less than 30 days prior
to your check in date, you will forfeit all sums paid, except your
security deposit. If the Owner is able to re-rent the property
to another party, at the same rate, for the same time period (or
greater), full payment minus the $75 cancellation fee will be returned.
CHECK IN: Check in time is 3:00 pm.
Keys will be issued at check in, after the balance owing and signed
agreements are collected.
CHECK OUT: Check out time is 10:00
am. Please leave all keys and remote controls at the studio. A
$50 fee will be charge for lost keys. A $200 fee will be charged
for lost remote controls.
KEYS: One set of keys will be issued
to the Tenant upon arrival. Keys will be returned to Owner upon
leaving, or a $50 lost key charge will be taken from the security
deposit.
PETS. Tenant may not bring or keep
pets in the Rented Premises.
CLEANING: Each property will be inspected,
sanitized and cleaned after your departure. The rental fee you
have paid will provide for four hours of normal cleaning so that
you can enjoy your vacation up to the last moment. You are required
to leave the property in the same general condition that you received
it my making sure the studio is generally picked up and ready to
be vacuumed, dusted and sanitized. If additional cleaning is required,
appropriate charges will be deducted from your security deposit
at the rate of $50 per hour.
If you visit is longer than one week, your room will be cleaned on a
once-per-week basis. This weekly cleaning will consist of washing the
linens and towels, cleaning the bathroom, dusting and vacuuming. The
studio is also supplied with a vacuum cleaner for the Tenant's use.
LAUNDRY: There is not a washer and
dryer that is included in the rental. There is also a coin Laundromat
located two blocks away from the studio (see informational binder
in studio).
WHAT WE SUPPLY: The studio is equipped
and set up as a fully furnished property that includes bedspreads,
linens, blankets, pillows, towels, iron, ironing board and well
as a fully equipped kitchenette. There will be extra charges to
your security deposit for replacing these items if found to be
necessary.
WHAT YOU SHOULD BRING: Plan on packing
your personal toiletry items, and additional paper products you
deem necessary. Please bring your own beach and hot tub towels. There
is no telephone in the studio.
TENANTS LIABILITY: Tenant agrees
to take good care of the Rented Premises and all equipment and fixtures
contained therein and accept liability for any damages caused to
the property (other tan normal wear and tear) by tenant or Tenants
guests, including, but not limited to, landscaping, misuse of appliances,
and/or equipment furnished. If damages are in excess of the security
deposit being held, Tenant agrees to reimburse the Owner for the
costs incurred to repair/replace damaged items. Any required repairs
shall be immediately reported to the Landlord.
FURNISHINGS AND APPLIANCES. The studio
comes fully furnished with both antique and new furniture. Tenant
agrees to not damage furnishings and to take special care of furniture. No
wet or damp items shall be placed on the wooden furniture.
All containers with liquid (glasses, vases, etc) shall be placed
on a waterproof barrier (coaster) and not placed directly on the
wooden surfaces. Kitchenette appliances shall be cleaned prior
to move-out. Any cost to replace damaged appliances shall be the
Tenant's responsibility.
HOT TUB AND DECK/PATIO: Tenant hereby
acknowledges that the studio rental included a hot tub, and the
undersigned is fully aware the hot tub and surround deck/patio
can be dangerous, that the deck/patio can be slippery when wet,
and that injury is likely to occur to anyone who is not careful.
Tenants should observe and adhere to all rules and policies as
posted on the property. With full knowledge of the above facts
and warnings, the undersigned accepts and assumes all risks involved
in or related to the use of the hot tub and deck/patio areas.
SLEEPING CAPACITY: Tenants and all
other occupants will be required to vacate the premises and forfeit
the rental fee and security deposit for exceeding the four (4)
person maximum sleeping capacity.
DISTURBANCES: Since you will be enjoying
the benefits of residing in a residential neighborhood, noise levels
shall be kept to a minimum between the hours of 9:00 pm and 9:00
am. Tenants and all other occupants will be required to vacate
the premises and forfeit the rental fee and security deposit for:
using the premises for any illegal activity; causing damage to
the premises rented or to any of the neighboring properties; and,
other acts which interferes with the neighbors' right to quiet
enjoyment of their property.
LAWS AND REGULATIONS. Tenant must,
at Tenant's expense, comply with all laws, regulations, ordinances
and requirements of all municipal, state and federal authorities
that are effective during the term of the rental agreement, pertaining
to the use of the premises.
HOLD HARMLESS: The Owner does not
assume any liability for loss, damage, or injury to person or their
personal property. Neither do we accept the liability for any inconvenience
arising from any temporary defects or stoppage in supply or water,
gas, electricity or plumbing, Nor will the Owner accept liability
for any loss or damage caused by weather conditions, natural disasters,
acts of God, or other reasons beyond their control.
OWNER'S RIGHT TO ENTER. Owners may,
at reasonable times, enter Rented Premises to make repairs. Reasonable
times are between the hours of 9:00 am and 9:00 pm with 24 hours
notice, or any time for emergency repairs.
ADDITIONAL TERMS AND CONDITIONS: The
undersigned, or the undersigned's heirs, assignors, executors,
and administrators, fully release and discharges Owner from any
and all claims, demands and causes of action by reason of any injury
or whatever nature which has or have occurred, or may occur to
the undersigned, or any of his/her guests as a result of, or in
connection with the occupancy of the premises and agrees to hold
Owner free and harmless of any claim or suit arising there from.
In any action concerning the rights, duties or liabilities of the
parties to this agreement, their principals, agents, successors,
or assignees the prevailing party shall be entitled to recover
reasonable attorney fees and costs.
REMEMBER THAT YOU ARE RENTING A PRIVATE HOME. PLEASE
TREAT IT WITH THE SAME RESPECT YOU WOULD LIKE SHOWN TO YOUR OWN
